Software Licence, Copyright Notice and Third-Party Attributions

1. Duncan Beat Licence

Duncan Beat - Music Engine, including the application, source code, user interface, music-generation logic, MIDI-generation algorithms, arrangements, presets, configuration files, instrument definitions, audio samples, generated demonstration material and associated documentation, is protected by copyright and other applicable intellectual property laws.

Except for third-party components identified below, all rights in Duncan Beat are reserved by the copyright holders.

Unless a separate written licence has been granted, Duncan Beat is licensed solely for:

  • Personal use.
  • Private use.
  • Evaluation and testing.
  • Non-commercial musical experimentation.

2. Permitted Use

Subject to the terms of this licence, you may use Duncan Beat on your own devices for private and non-commercial purposes.

You may use the software to generate and play MIDI material for personal practice, musical education, experimentation and private composition.

Permission to use Duncan Beat does not transfer ownership of the software, audio content, source code, presets or any other proprietary material included with the application.

3. Restrictions

Unless expressly authorised in writing by the copyright holders, you may not:

  • Redistribute, publish, share, sublicense, rent, lease, sell or otherwise make Duncan Beat available to third parties.
  • Redistribute or sell the source code, compiled software, MIDI files, presets, instrument definitions or audio samples included with Duncan Beat.
  • Use Duncan Beat or any substantial part of it as part of another commercial product or service.
  • Incorporate Duncan Beat audio samples into another sample pack, sound library, virtual instrument, sampler product or similar collection.
  • Extract, isolate or redistribute individual audio samples supplied with Duncan Beat.
  • Sell, license or commercially distribute proprietary presets or instrument definitions supplied as part of Duncan Beat.
  • Remove, obscure or alter copyright notices, licence notices, attribution information or proprietary markings.
  • Represent Duncan Beat, its source code, samples, algorithms or other proprietary content as your own work.
  • Circumvent technical measures intended to enforce access, licensing or usage restrictions.

4. MIDI Files and Generated Musical Content

Duncan Beat can generate MIDI data from chord progressions, musical patterns, rhythmic structures, arrangements and other user or system supplied information.

MIDI files supplied as part of Duncan Beat, including demonstration MIDI files, presets and example arrangements, remain subject to this licence unless otherwise stated.

Where Duncan Beat generates a new MIDI file from user input, the copyright status of the resulting musical material may depend on the nature of the input, the musical content supplied by the user and the applicable law.

Users are responsible for ensuring that chord sequences, melodies, MIDI files or other content submitted to Duncan Beat do not infringe third-party rights.

5. Audio Samples and Instrument Content

Audio samples, sampled instruments, instrument definitions, presets and related sound-design content supplied directly by Duncan Beat are licensed as part of Duncan Beat and are not provided as standalone royalty-free sample libraries unless expressly stated otherwise.

You may use those sounds through Duncan Beat for uses allowed by this licence, but you may not extract or redistribute the underlying samples themselves.

Important: A licence to use Duncan Beat does not automatically grant a licence to redistribute the underlying audio samples.

6. Commercial Use

Commercial use is not permitted under the standard Duncan Beat personal licence unless expressly authorised in writing.

Commercial use includes, without limitation:

  • Selling or licensing Duncan Beat itself.
  • Incorporating Duncan Beat into a paid application, subscription service or commercial platform.
  • Redistributing Duncan Beat samples, presets or source code.
  • Using Duncan Beat as part of a commercial sample library, instrument library or software product.
  • Providing Duncan Beat to third parties as part of a paid service.

Separate commercial licences may be available from the copyright holders.

7. Intellectual Property

Duncan Beat, its software architecture, source code, composition engine, MIDI-generation system, user interface, branding, original presets, original audio content and documentation remain the intellectual property of their respective copyright holders.

Nothing in this licence assigns or transfers ownership of any intellectual property rights to the user.

8. Third-Party Software

Duncan Beat makes use of third-party open-source software. Those components remain subject to their own licences and copyright notices.

The Duncan Beat licence does not replace, restrict or modify the rights granted under those third-party licences.

Additional third-party libraries may be used by particular versions or builds of Duncan Beat. Their respective copyright and licence notices apply.

9. Tone.js

Duncan Beat uses Tone.js for browser-based audio processing, synthesis and musical scheduling.

Tone.js is an independent open-source project and is not owned by, affiliated with, sponsored by or endorsed by Duncan Beat.

Tone.js is distributed under the MIT Licence. Use of Tone.js within Duncan Beat remains subject to the Tone.js copyright notice and licence terms.

10. @tonejs/midi

Duncan Beat uses the @tonejs/midi library for reading and processing MIDI file data in the browser.

@tonejs/midi is separately licensed under the MIT Licence and remains the property of its respective authors and contributors.

11. Bootstrap

Parts of the Duncan Beat interface use Bootstrap for responsive layout and user-interface styling.

Bootstrap is open-source software distributed under the MIT Licence. Its own copyright and licence terms continue to apply independently of this Duncan Beat licence.

12. Microsoft .NET, ASP.NET Core and Blazor

Duncan Beat is built using Microsoft .NET technologies, including ASP.NET Core and Blazor.

ASP.NET Core is an open-source Microsoft project distributed under the MIT Licence.

Microsoft trademarks and product names belong to Microsoft Corporation and their respective owners.

13. Third-Party Trademarks

Tone.js, Bootstrap, Microsoft, .NET, ASP.NET Core, Blazor, MIDI and any other third-party names, trademarks, product names or logos referenced by Duncan Beat belong to their respective owners.

Their inclusion is for identification and attribution only and does not imply sponsorship, affiliation or endorsement.

14. No Warranty

Duncan Beat is provided "as is" and "as available", without warranties of any kind, to the maximum extent permitted by applicable law.

The copyright holders do not warrant that the software will be uninterrupted, error-free, suitable for a particular purpose or compatible with every browser, operating system, MIDI device, audio device or third-party system.

15. Limitation of Liability

To the maximum extent permitted by applicable law, the copyright holders shall not be liable for indirect, incidental, consequential, special or similar damages arising from the use of or inability to use Duncan Beat.

This includes, without limitation, loss of data, loss of musical work, loss of income, loss of opportunity or damage resulting from incompatibility with third-party software, devices or services.

16. User Content

Users remain responsible for material they import into or process using Duncan Beat, including MIDI files, chord sequences, song structures, audio files and other musical information.

Users must have the necessary rights or permissions for any third-party material they use with Duncan Beat.

17. Termination

Your permission to use Duncan Beat may terminate if you materially breach the terms of this licence.

On termination, you must cease unauthorised use and distribution of Duncan Beat and any proprietary Duncan Beat content in your possession.

18. Separate Licences

Certain versions, modules, sample collections or commercial deployments of Duncan Beat may be supplied under separate written licence terms.

Where a separate written agreement exists, that agreement takes precedence over this standard licence to the extent of any conflict.

19. Commercial Licensing

Commercial, distribution, integration, OEM and other licensing arrangements may be available.
